What California Law Actually Says About Cleaning Deductions

California Civil Code Section 1950.5 is the rule that governs your security deposit. Under that law, a landlord can only deduct for cleaning that is necessary to return the unit to the condition it was in when you moved in, accounting for normal wear and tear. That phrase matters a lot. Landlords cannot charge you for repainting walls that faded over two years, re-caulking a tub that dried out on its own, or refinishing floors that show light scuff marks from everyday use. Those are wear and tear. What they can charge for is actual dirt, grease, stains, and grime you left behind.

The landlord must also mail or deliver an itemized statement of deductions within 21 days of you handing over the keys. If they miss that window without a valid reason, they generally forfeit the right to keep any of your deposit. Keep a copy of your move-out date confirmation in writing.

Normal Wear and Tear vs. Dirt: Where the Line Is

The distinction is whether a reasonable cleaning effort during your tenancy would have prevented the condition. If the answer is yes, the landlord can deduct the cost of a professional cleaner to fix it.

The Walkthrough Checklist Property Managers Actually Use
